(Attributes and Kinds of Supply Contract in Islamic Law )

Abstract

Each member of any society needs to enter into some contracts to fulfill his daily and livelihood needs. Supply Contract is the most utilized contract in any human society. This research article is a discussion on the attributes and kinds of supply contracts. Basically this topic deals with two main dimensions which are attributes and kinds of supply. As for as the attributes of this contract are concerned, the main attributes are that this contract is consensual, compensatory, specific, holding, extended, contractor and is binding on the parties of the contract. The kinds of this contract have been discussed under four main divisions which are: freedom of contractor to accept or refuse the contract, nature of contract, subject matter of the contract and place of contract. Overall eight types of supply contract and its importance has been discussed within these four divisions which are: standard and free, administrative and private, regular and industrial and lastly local and international supply contracts. All these types of the contracts have been elaborated with illustration and expert opinions of contemporary Islamic jurists. Findings of the discussions as well as suggestions and recommendations have also been mentioned at the end of the discussion.
