مالِ محجور سے زکوٰۃ کی ادائیگی کا مسئلہ
فقہی مسالک اور ان کے دلائل کا تقابلی مطالعہ
Abstract
Zakat is mandatory for adult, wise and people having specific amount of property. There are different points of view regarding payment of zakat in the property of the persons restricted from any act in their property such as minor and insane persons. The famous view point of Ahnaf is that Zakat is not mandatory in the property of such restricted persons, on the other hand Ibn-e-Masood and Aozai have the view that zakat is not payable till they attain the age of puberty. On attaining this condition, it is conveyed to them either they pay Zakat or not. This view point is near to above mentiond view. According to Fiqh-i-Jafriah, if the property of minor (yatim) is invested then zakat will be mandatory otherwise not. According to the unanimous view of Imam-i- Malik, Shafai and Ahmad Bin Hambal the zakat is mandatory in property of insane, lunatic, minor and their guardians will have to pay the zakat on their behalf. This viewpoint seems preferable and better.
