Abstract

In Islam there are few compulsory conditions or stipulations for defensive warfare or any militant movement. Without fulfilling or conforming those conditions, not even a single act of warfare could be marked as jihad in Islam. The first and foremost stipulation is that the only highest and legitimate authority of the state is authorized to permit any militant or defensive warfare. Not even a single religious organization or militant group has an authority to launch a warfare on their own. Such an act is against Islamic laws and international regulations. The second condition is that it is not allowed unless the head of Muslim state makes it legitimate for everyone to participate. Therefore, jihad is not performed until it is allowed by parliament or legitimate state authority. The third stipulation is that it is incumbent upon Islamic state to make sure the availability of modern warfare requisites and required forces before entering the battlefield. Pushing armed forces  into a warfare without ensuring enough militant power will be marked as suicidal act in Islam. Fourth condition to be fulfilled is to ensure the massive manpower (armed forces) according to the sum of janibeen (number of warriors on both sides)   as mentioned in Quran. The fifth and last provision for jihad bil saif  is to announce war  formally along with ultimatum before attacking any state. Without fulfilling aforementioned conditions, no act of armed conflict could be marked as Jihad bil saif or qitaal in Islam.
